Acceptance of Terms

These Terms of Service govern your access to and use of Niyavo. By creating an account, accessing the service, or using any Niyavo feature, you agree to be bound by these Terms. If you do not agree, you should not use Niyavo.

Description of Service

Niyavo is a fitness guidance app that helps users organize daily practices across training, nutrition, mobility, recovery, hydration, sleep, running, movement, and calm. The service may provide personalized suggestions based on information you choose to provide and integrations you choose to connect.

Account Registration

You may need an account to use Niyavo. You agree to provide accurate information, keep your account credentials secure, and promptly update information that becomes inaccurate. You are responsible for activity that occurs through your account.

Acceptable Use

You agree not to misuse Niyavo, interfere with the service, attempt unauthorized access, scrape or harvest data, abuse support channels, reverse engineer the service, or use Niyavo in a way that violates applicable law or the rights of others.

User Content

You own the fitness, health-adjacent, profile, and other content you provide to Niyavo. You grant Niyavo a limited license to host, process, transmit, and display that content solely as needed to operate, maintain, secure, and improve the service and provide the features you use.

Subscription and Billing

PLACEHOLDER: Subscription terms will be added when paid plans launch. Any final paid plan terms will describe pricing, renewal, cancellation, refunds, taxes, trial periods, and app store billing rules before users are charged.

Medical Disclaimer

Niyavo is not medical advice and is not a substitute for diagnosis, treatment, or guidance from a qualified healthcare professional. Consult a healthcare provider before starting any fitness, nutrition, running, recovery, or wellness program. Users with medical conditions, injuries, pregnancy, medication concerns, or other health risks should obtain medical clearance before using Niyavo recommendations.

Disclaimers and Limitation of Liability

Niyavo is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Niyavo disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. Niyavo is not responsible for health outcomes, training results, lost data, lost profits, or indirect, incidental, consequential, special, or punitive damages arising from your use of the service.

Termination

You may stop using Niyavo at any time and delete your account through Profile. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for other users, or used the service unlawfully.

Governing Law

These Terms will be governed by the laws of [Jurisdiction TBD by founder], without regard to conflict of law principles.

Changes to Terms

We may update these Terms as the service evolves. If changes are material, we will notify you by email or through the service before the updated Terms take effect. Your continued use of Niyavo after an update means you accept the revised Terms.
